This Privacy Policy aims to give you more information about our privacy practices and to give you more insight into our privacy choices when you use our website and services. Definitions

Personal data: All information about an identified or identifiable natural person (the data subject): as an identifiable natural person who can be identified directly or indirectly, in particular by means of an identifier such as a name, an identification number, location data, an online identifier or one or more elements characteristic of the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person. Personal data can be identified directly or indirectly.

Processing: An operation or a set of operations relating to personal data or a set of personal data, whether or not performed via automated processes, such as collecting, recording, organizing, structuring, storing, updating or modifying, retrieving, consulting, using, providing by means of forwarding, distributing or otherwise making available, aligning or combining, protecting, deleting or destroying data.

Responsible for processing: A natural or legal person, a government agency, a service or any other body that, alone or together with others, determines the purpose and the means for the processing of personal data; when the objectives of and the means for this processing are established in the law, it is possible to determine who is responsible for the processing or according to which criteria it is designated. AutoPro is the controller for personal data.

Processor: A natural or legal person, a government agency, a service or another body that processes personal data on behalf of the controller.

What personal data do we collect and process?

The types of personal data that we usually collect and process include:

Identification data: To register you as an “AutoPro contact”, we collect your company name, address, telephone number, e-mail address and VAT number. If you want to buy a product or service, you must provide a copy of your ID document and proof of registration in the trade register.

Transaction details: If you want to buy a product or service, we collect additional financial information such as your bank account number. We do not collect or use sensitive personal information related to religious, political or philosophical beliefs, sexual orientation, ethnic origin or health.

Why do we use your personal data?

In principle, we will use your personal data:

  • in the context of the execution of a contract,
  • to comply with laws and regulations,
  • for the legitimate interests of our company to function as a commercial company,
  • to be able to provide you with relevant products and services when we have your consent,
  • to optimize our services,
  • to prevent and detect breaches of laws and regulations to which we are bound.

How long do we keep your personal data?

We do not store your personal data longer than necessary for the purposes for which it was collected.

As far as potential customers are concerned, we store personal data for 2 years. Customer and supplier data are retained for the duration of the contract and during the legally required period that follows, as explained in the next section.

When assessing the retention period of personal data, we adhere to the data storage requirements as prescribed by the applicable legislation (eg 7 years in the case of invoices).

In certain cases, we may be required by a supervisory authority or due to an ongoing process to retain certain data longer than the aforementioned period. In that case, we only retain the data insofar as this is strictly necessary for the authority or for the process.

With whom do we share your personal data?

In some cases we are legally obliged to share your data with external parties to which we are required by law to transfer personal data. These authorities include tax authorities, police, courts, arbitration / conciliation bodies as well as lawyers.

We can also transfer personal data to trusted third parties. These third parties include providers of internet services, cloud services, transport companies or financial institutions. We do not transfer your personal data to third parties for secondary use or unrelated purposes.

In the case of third parties outside Belgium, we ensure that personal data are adequately protected abroad. In case personal data are transferred outside the European Economic Area (EEA), the protection of personal data differs from that in the EEA. For those cases, we have taken appropriate protective measures to ensure that personal data are processed according to the standards that apply in Belgium. These measures include EU model clauses, password protection, where appropriate encryption of data, limited access to personal data as further explained in the next section.

Security of your data is important

AutoPro strives to take all reasonable and appropriate measures to protect the personal data we keep against loss, misuse and unauthorized access.

To this end, we use a safety management structure; only employees who need access to personal data in the course of their work also have access to this.

Your rights with regard to your personal data

You have the right to access your personal data. If you so request, we will provide you with a description of the personal data we hold about you, the reason why we collect your data, the external parties to whom the data is transferred and the reasons for any automatic processing of your data.

You have the right to correct your personal data. If you believe that your information is incorrect (or incomplete), you can ask us to rectify it.

You have the right to have your personal data deleted. If you suspect that we are processing your data unlawfully, you can ask us to delete it.

You have the right to restrict our use of your personal data or to object to it.

You have the right to transfer your personal data in the context of data portability.
